Terms

Orchestra is operated by Orchestra Productions Inc., a Delaware corporation, “we” and “us” below. Email: hello@orchestra.build.

These terms cover the public orchestra.build pages, the early-access interest list and company enquiries. Joining the list does not create a product account or grant product access.

1 · What this site is

The public site describes Orchestra and lets people and companies express interest. Product access is separate and may open in stages.

You must be at least 18 years old to submit an early-access request, ask us to hold a name, or submit a company enquiry.

2 · Requesting early access

Submitting your email address asks us to add you to the early-access interest list.

It does not guarantee you access. We may open access in stages, in any order, and we may never open it to you at all. We are not promising a date, a place in a queue, or a spot.

You agree that the address you submit is yours to give.

3 · Asking us to hold a name

A name reservation is a request, and nothing more. It gives you no ownership, no licence, no property right, and no guarantee that the name will ever be available to you.

When you ask us to hold a name, you tell us that:

• you have the right to use it;
• it does not impersonate any person or organisation; and
• it does not infringe anyone’s trademark or other rights.

We may refuse, cancel, change, or reassign any held name at any time, for any reason, with no notice and nothing owed to you — including when someone else claims a right to it, and including if we decide the whole idea should work differently.

If you believe a held name infringes your rights or impersonates you, write to hello@orchestra.build and we’ll look at it.

4 · What we’re not promising

Orchestra is in development. Anything on this site describing what Orchestra is or will be is a statement of intent, not a commitment. Features described may change, be delayed, or never exist. Nothing here is a warranty, a guarantee, or a contract for a product.

The site is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind. To the fullest extent the law allows, we disclaim all implied warranties, including any implied warranty of merchantability, fitness for a particular purpose, title, and non-infringement. We don’t warrant that the site will be uninterrupted or error-free.

5 · What belongs to whom

The Orchestra name, wordmark, page design, text, and any video or imagery on this site are used by us and, as between you and us, are ours. You may link to the site freely. Please don’t reproduce the content or use the name and marks as your own.

Please do not send confidential information through the public forms or by email. If you voluntarily send feedback about Orchestra, you give us permission to use it to improve Orchestra and our services, without compensation or attribution.

6 · Behaving reasonably

Please don’t:

• Submit addresses that aren’t yours, or submit them in bulk
• Reserve names in bulk, or reserve names you have no right to use
• Attempt to break, overload, scrape, or probe the site
• Attempt to access parts of the system not meant for you

We may remove any entry, release any held name, and block any address or connection at our discretion.

7 · Limits

To the extent the law allows: we are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of this site, or for lost profits, lost data, or loss of goodwill. Our total liability for all claims relating to this site is limited to one hundred US dollars (US$100).

Some places don’t allow these limits. If yours doesn’t, they don’t apply to you.

8 · Privacy

How we handle your information is described on the Privacy page. It’s short.

9 · Changes and ending

We may change these terms. If we do, we’ll update the date above. We may take this site down or change it at any time.

10 · Law and where disputes go

These terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-laws rules. Any dispute goes to the state or federal courts located in Denver County, Colorado, and you and we each consent to that venue. If any part of these terms is unenforceable, the rest still applies.

Nothing here takes away rights you have under the consumer law of the country you live in.
