Orchestra is operated by Orchestra, Inc., a Delaware corporation — “we” and “us” below. Email: hello@orchestra.build.
These terms cover your use of the orchestra.build website. The website currently does two things: it lets you ask to be told when Orchestra is ready, and it lets a company ask about Orchestra for the people it serves. These terms cover that, and nothing more.
1 · What this site is
A page describing Orchestra, a form to request early access, and a form for companies to ask about it. Orchestra itself is not available yet. Nothing on this site is a product you can use today.
2 · Requesting early access
Submitting your email address puts you on a list. It is a request, not an agreement.
It does not guarantee you access. We may open access in stages, in any order, and we may never open it to you at all. We are not promising a date, a place in a queue, or a spot.
You agree that the address you submit is yours to give.
3 · What we’re not promising
Orchestra is in development. Anything on this site describing what Orchestra is or will be is a statement of intent, not a commitment. Features described may change, be delayed, or never exist. Nothing here is a warranty, a guarantee, or a contract for a product.
The site is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind. To the fullest extent the law allows, we disclaim all implied warranties, including any implied warranty of merchantability, fitness for a particular purpose, title, and non-infringement. We don’t warrant that the site will be uninterrupted or error-free.
4 · What belongs to whom
The Orchestra name, wordmark, page design, text, and any video or imagery on this site are used by us and, as between you and us, are ours. You may link to the site freely. Please don’t reproduce the content or use the name and marks as your own.
Anything you send us — feedback, a suggestion, an idea, a reply to an email — you grant us a perpetual, irrevocable, worldwide, royalty-free, transferable and sublicensable licence to use, copy, modify, adapt and commercialise it, in any medium, with no obligation of confidentiality, attribution, or payment to you. Don’t send us something you need kept confidential or need to be paid for.
5 · Behaving reasonably
Please don’t:
- Submit addresses that aren’t yours, or submit them in bulk
- Attempt to break, overload, scrape, or probe the site
- Attempt to access parts of the system not meant for you
We may remove any entry and block any address or connection at our discretion.
6 · Limits
To the extent the law allows: we are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of this site, or for lost profits, lost data, or loss of goodwill. Our total liability for all claims relating to this site is limited to one hundred US dollars (US$100).
Some places don’t allow these limits. If yours doesn’t, they don’t apply to you.
7 · Privacy
How we handle your information is described on the Privacy page. It’s short.
8 · Changes and ending
We may change these terms. If we do, we’ll update the date above. We may take this site down or change it at any time.
9 · Law and where disputes go
These terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-laws rules. Any dispute goes to the state or federal courts located in Denver County, Colorado, and you and we each consent to that venue. If any part of these terms is unenforceable, the rest still applies.
Nothing here takes away rights you have under the consumer law of the country you live in.
